Mitchell Epner is a Member of Rottenberg Lipman Rich, PC. He has been trial counsel in numerous high-profile matters ranging from complex commercial litigation to White Collar criminal matters, including:.
- Estate of Claudia Cohen v. Cohen, where he successfully defended Robert Cohen (the Chairman of the Board of Hudson News) against an $800M claim by Ron Perelman (How Ronald Perelman met his match - Jan. 8, 2010 (fortune.com), and ultimately won an 8-figure verdict on his client’s counterclaim.
- Representation of leading multi-national branded pharmaceutical companies in patent litigation for leading therapies for Hepatitis C, HIV, and TB;
- Representation of a leading generic pharmaceutical company in successful ANDA litigation regarding Lovaza;
- Representation of EMI in the Napster II litigation, leading to the largest single-plaintiff settlement in history to that point;
- Representation of the senior-most Japanese executive in the United States for a Japanese auto parts manufacturer in the DOJ Antitrust Division’s In re Japanese Autoparts investigation (Auto Parts Investigation 2015 | ATR | Department of Justice), obtaining a complete non-prosecution for his client;

From 2001-04, Mitchell served as Assistant United States Attorney for the District of New Jersey, serving in the Public Protection Unit and concentrating on Involuntary Servitude, Alien Sex Trafficking, and related offenses..
Mitchell has frequently provided expert on-air commentary for CNBC, Fox Business, WGN, and the CBC, and been extensively quoted by the Wall Street Journal, NBC, ABC, the New York Daily News, Business Insider, Law & Crime, the Financial Times and other international newspapers. Mitchell also was a Jones Beach lifeguard from 1987-91, finished second in the 1987 Jeopardy! Teen Tournament ($13,800), and has been quoted five times by Bill Simmons. He currently serves on the Board of Directors of Eleanor’s Legacy and the Advisory Board for Sepsis Alliance and previously served on the Alumni Council of Dartmouth College.
